An elderly man accused of sexually assaulting fellow residents of a Redding senior home will apparently not stand trial. 89-year-old Milton John Miller was arrested in March and charged with four felony counts of sexual battery on institutionalized victims. Miller has prior felony convictions and is a registered sex offender. His crimes allegedly were committed while he was a resident of Sierra Oaks Assisted Living and Memory Care on Collyer Drive. In April his defense declared doubts about Miller’s mental state and a judge ordered that he be evaluated by a court appointed doctor. The evaluation determined that Miller is incompetent to understand the charges against him, and is not expected to be restored to competency. He’ll likely be placed under conservatorship and spend the rest of his days in a treatment facility. He returns to court August 4th. For now, he remains in Shasta County Jail on $100,000 bail.
